Conflicto de competencia suscitado entre la Sala Oral del Tribunal Administrativo de Nariño y la Sala Civil-Familia del Tribunal Superior de Pasto.
La Corte considera que la Sala Civil-Familia referida incumplió su obligación de resolver el recurso de alzada dentro del trámite de tutela, desconociendo con ello el contenido previsto en el artículo 32 del Decreto 2591 de 1991.
Se dirime el asunto con la remisión del expediente a la precitada autoridad, para que asuma de manera inmediata la impugnación formulada en contra de la decisión proferida por el Juzgado Primero Civil del Circuito Especializado en Restitución de Tierras de Tumaco.

- Primero. DEJAR SIN EFECTOS el Auto proferido el 13 de septiembre de 2017 por la Sala Civil-Familia del Tribunal Superior del Distrito Judicial de Pasto, a través del cual se abstuvo de tramitar la impugnación formulada por la Asociación Mutual Empresa Solidaria de Salud (EMSSANAR E.S.S.) y el Instituto Departamental de Salud de Nariño, dentro de la acción de tutela interpuesta por Anibar Aureliano Vargas España.
- Segundo. REMITIR el expediente ICC-3152 a la Sala Civil-Familia del Tribunal Superior del Distrito Judicial de Pasto (Nariño), para que asuma el conocimiento inmediato de la impugnación presentada dentro del proceso de tutela de la referencia.
- Tercero. Por la Secretaría General de la Corte, COMUNICAR a las partes y a la Sala del Sistema Oral del Tribunal Administrativo de Nariño, la decisión adoptada en esta providencia.
